DESCRIPTION

The Office for the Prevention of Harassment & Discrimination (OPHD) is responsible for ensuring the University provides an environment for students, faculty, and staff that is free from discrimination and harassment on the basis of protected categories. OPHD’s mission is to educate the entire UC San Diego community about these issues and to assist with prevention efforts, and prompt and effective resolution of all complaints. OPHD provides analysis and guidance in all areas pertaining to institutional compliance with federal and state laws, and University of California nondiscrimination policies. Reporting directly to the Chancellor’s Office, OPHD conducts civil rights investigations and guides senior campus leadership in all Vice Chancellor areas.

The Associate Director and Deputy Title IX Officer reports to the Director / Title IX Officer of the Office for the Prevention of Harassment and Discrimination (OPHD). Under general direction, the Associate Director and Deputy Title IX Officer assumes major responsibility for complaint resolution and investigations that respond to informal and formal complaints of harassment and discrimination of individuals in protected categories. Drawing on a strong legal background and expertise in UC and UC San Diego policies, the incumbent is a lead campus resource for matters pertaining to harassment and discrimination. They provide sound legal analysis and development of local policies and guidelines; mandated reporting; investigations and complaint resolution; and the development of associated trainings and briefings for campus leaders. The incumbent addresses formal and informal complaints and inquiries, assesses concerns, and consults with the university senior leadership.

The Associate Director and Deputy Title IX Officer exercises independent judgment in the intake, informal and formal investigations, and resolution of complaints and in establishing strategies for the resolution of identified problems. They provide impartial consultation, conflict resolution, and problem solving in response to informal and formal complaints and inquiries received from members of the campus community and affiliates to campus including faculty, staff, students, parents, and UC San Diego Health employees. They recommend to the Title IX Officer/Director and, where appropriate, directly to campus administrators or other individuals changes to policies and procedure to insure institutional equity and fairness and adherence to federal and state laws.

The incumbent is responsible for ensuring compliance with UC, UC San Diego and Federal regulations and policies, including, but not limited to, Title IX. The incumbent provides oversight to complaint resolution and investigations, as well as performs dispute resolution and training program development, and legal research and analysis for OPHD matters pertaining to equal opportunity, discrimination, and sex offense prevention and provides analytical support for special projects.

The Associate Director and Deputy Title IX Officer develops, implements, coordinates and evaluates education programs regarding harassment and discrimination based on protected categories for the entire UC San Diego campus community, with special emphasis on UC San Diego's student population and on UC San Diego Health.

The Associate Director and Deputy Title IX Officer assumes responsibility for OPHD in the absence of the OPHD Director/ Title IX Officer. The Associate Director and Deputy Title IX Officer represents UC San Diego on behalf of the OPHD Director/ Title IX Officer on various campus and UC committees.

QUALIFICATIONS

  • JD or Advanced Degree, or an equivalent combination of education and 10 years experience in the field/specialty.

  • Experience and advanced knowledge of the ethics and compliance profession, theories and systems of internal control, and professional compliance and investigations standards. Knowledge of conflict resolution, mediation skills and techniques, communication, listening skills, and diversity issues. Deep and broad knowledge of federal and state law pertaining to discrimination and sexual harassment. Professional knowledge of other elements of human resources law. Strong knowledge of caselaw, University policy, trends and issues.

  • Broad and thorough knowledge of University ethics and compliance policies, procedures and programs.

  • Demonstrated experience in exercising independent judgment in the assessment, investigation, and resolution of concerns brought to the Office for the Prevention of Harassment and Discrimination. Strong skills in and working knowledge of conflict resolution, problem solving techniques, screening, interviewing, advising and investigation. Strong analytical skills and the ability to assess and negotiate complex, highly sensitive situations.

  • Ability to apply appropriate policies and practices in the completion of ethics and compliance assignments. Skills in critical decision making.

  • Ability to extract, verify, compile and develop recommendations related to ethics and compliance programs, issues, policies and procedures.

  • In-depth abilities in collaboration, facilitation, and strategic and creative thinking.

  • Thorough understanding of the interrelationship of procedures and desired results.

  • Excellent interpersonal and problem solving skills to work independently with all levels of University personnel, including management and faculty, and to facilitate agreement on issues and corrective actions. Strong and effective interpersonal skills: the ability to listen well, be a creative problem solver, demonstrate sensitivity to, and respect for people's needs. Work as part of a university-wide community to resolve complaints and issues and be empathetic toward others.

  • Ability to present complex issues in a clear and concise manner, both in writing and verbally for presentation or review by senior leadership. Demonstrated written and oral communication skills at a high management level. Professional expertise in writing concise, logical and grammatically correct analytical reports to convey complex and sensitive issues.

  • Knowledge of computers and word processing; experience with database and tracking programs.

  • Exceptional knowledge of Title IX regulations and related law and policy. Knowledge of state and federal laws regarding harassment and discrimination based on protected categories.

  • Exceptional skill in developing and delivering training and education programs about discrimination and sexual harassment. Ability to effectively conduct training and education programs, workshops, and other presentations for small and large groups, including senior academic and administrative leaders and their direct reports. Strong presentation and training skills to prepare, organize and present OPHD outreach, conflict resolution, and other training to groups.

  • Ability to maintain confidentiality and be discrete. Commitment to principles of due process, fairness and respect. Ability to maintain neutrality in the face of resistance, indifference or hostility. Demonstrated experience in performing under stress with frequent interruptions and distractions.
